Weston ZBA declares 269 North Ave. extension request moot under new state law

WESTON — December 12, 2024 — Weston ZBA finds 269 North Ave. permit-extension request moot after new state law tolls it two years. The board voted 3-0 Thursday to drop Attorney Adam Costa's Nov. 22 request for a six-month extension of the Dec. 15 commencement-of-construction deadline on the 40B comprehensive permit at 269 North Ave., after concluding that Section 280 of Chapter 238 of the Acts of 2024 — the 2024 Economic Development Act — automatically extended the permit by two years to December 2026. Town Counsel George Pucci of KP Law confirmed the statute "would clearly apply to this permit." Chair Jane Fisher Carlson, joined by members Steve LaRock and Laura Mintz, said acting on the superseded request would only get the record "tangled up." Costa said the applicant obtained its building permit on or about Dec. 3 and intends to begin construction as soon as possible.
