Weston ZBA continues 269 North Ave permit appeal to March 13
WESTON — February 3, 2025 — Weston ZBA continues appeal of five 269 North Ave building permits to March 13. The board voted 3-0 on Feb. 3 to push substantive hearings on appellant Brian Johnson's challenge to permits BP 2024-588 through BP 2024-592, with chair Jane Fisher Carlson citing two unfinished reviews. Town stormwater consultant Ken Staffier will deliver his analysis of an engineering critique from appellant's engineer John Chessia by Feb. 24, and town counsel George Pucci is reviewing a Jan. 31 letter from developer's attorney Adam Costa of Mead, Talerman & Costa challenging the appeal's legal sufficiency. Building Inspector John Field confirmed construction is proceeding "at their own peril," with fencing and erosion controls already installed. Attorney Dan Hill of Hill Law, representing Johnson, noted the board faces an April 9 statutory deadline — "if you fail to take action within that 100-day period, the appeal is deemed to be approved." Fisher Carlson stressed that overturning the permits will require a unanimous vote of the three sitting members.
