Weston ZBA Approves Eight Replacement Maples for 269 North Ave. Tree Removal

WESTON — July 2, 2025 — Weston ZBA accepts notice of project change for 269 North Ave., ordering eight replacement maples after developer cut four protected trees. The Zoning Board of Appeals voted 2-1 at its July 2 meeting to find the inadvertent removal of three oaks and one white pine an insubstantial change to the project's Chapter 40B comprehensive permit, with Chair Jane Fisher Carlson and Associate Member Laura Mintz voting in favor and Chair Stephen J. Larocque dissenting. Developer's attorney Adam Costa of Meilerman and Costa had proposed a one-to-one replacement with a one-year warranty; the board secured an agreement for eight red maple trees between 15 and 20 feet in height, a two-year post-construction warranty, and placement outside the septic-system footprint at the rear of the lot. Town Counsel George Pucci of KP Law advised that a written decision memorializing the agreed terms would follow. Larocque, in dissent, said the string of project changes at the site was "beginning to border on a substantial change."
