Weston ZBA grants six-month extension on 269 North Avenue 40B permit
WESTON — June 4, 2024 — Weston ZBA extends 269 North Avenue 40B lapse date to December over architect's dissent. The board voted 2-1 on June 4 to grant a six-month extension of the comprehensive-permit lapse date, moving the construction-commencement deadline from June 15 to Dec. 15, 2024. Chair Jane Fisher Carlson and member Laura Mintz voted yes; member Stephen J. Larocque, an architect tracking the five-building project since 2017, voted no, citing unresolved code issues and a town specialized energy code taking effect July 1. Attorney Adam Costa, successor to retired attorney Brian Levy, said the applicant has been pursuing a building permit since March 2023 and is closest on Building E. Town Counsel George Pucci of KP Law warned a denial would likely be overturned by the state Housing Appeals Committee. Hill Law attorney Caitlin Baptista, for abutter Brian Johnson of 287 North Avenue, urged the board to flag concerns about piecemeal permitting to Building Commissioner John Field.
