Weston ZBA finds 75 Newton Street land swap de minimis, no amendment needed
WESTON — January 4, 2022 — Weston ZBA finds 75 Newton Street land swap de minimis in 3-0 vote. Chair Jane Carlson, with members Alan Rose and Natalie Sawyer, ruled Tuesday that a three-property lot-line exchange — 311 square feet from 75 Newton to 85 Newton, with 165 and 170 square feet flowing back from 85 and 83 Newton — does not require amending a 2014 variance and special permit for the Zhang-Han property. Attorney Jonathan White said Town Counsel John Field had already ruled no variance was needed and the Planning Board signed the ANR plan. Co-owner Claire Han framed the swap as cleaning up a driveway encroachment inherited from a prior builder at 85 Newton: "It's new year, time to clean up some historic problems." The board declined to reach a 1996 variance staff could not locate in the registry; Rose said he agreed with the finding but "I don't like loose ends."
