Weston ZBA Approves Concord Road Addition, Rejects Deck and Carport

WESTON — May 2, 2023 — Weston ZBA approves a home addition but denies a second-story deck, rejects an unpermitted carport, and punts on a pool case in a six-vote evening. Sitting in two successive panels, the board voted unanimously on all six actions taken May 2. Chair Jane Carlson and members Wendy Kaplan-Armor and Laura Mintz approved a 33.8-by-19.9-foot addition at 490 Concord Road for applicants Niong Bui and Hong Lin Hodak but rejected their proposed elevated deck as adding impermissible mass to a structure already 17.7 feet from the side property line, with Kaplan-Armor saying she could not support "a second story being built — it's a big deck." A second panel of Carlson, Stephen Larock, and Winifred Lee denied both a special permit and a variance, without prejudice, for a carport shed erected without a building permit by Michael and Rochelle Membro at 61 Beaver Road, while waiving potential $300-per-day fines for 180 days from May 2 to give the owners time to act. The board separately denied a special permit for an 8-by-15-foot pool at 93 Concord Road, finding the request should be a variance, and continued the companion garage-addition application to May 23.
