WESTON -- March 13, 2025, Weston ZBA continues contested 40B building permit appeal for 269 North Ave., setting a March 25 hearing. The Zoning Board of Appeals voted unanimously to continue rather than decide a challenge to five building permits, BP 2024-588 through BP 2024-592, issued December 3, 2024 for a 16-unit Chapter 40B project developed by 269 North Ave LLC, with appellant Brian Johnson represented by attorney Dan Hill arguing the permits must be revoked because the project's subsurface stormwater system violates state stormwater standard two. Civil engineer John Chessia called the omission of a catch basin to control parking lot runoff toward Johnson's abutting property "pretty egregious," while VHB peer reviewer Ken Staffier characterized the outstanding concerns as "minor" and the permits as properly issued. Town counsel George Pucci of KP Law told the board it was "99.9 percent certain" his written opinion would confirm the stormwater handbook is binding regulation, a determination that could force the applicant to redesign the entire drainage system. The board faces a statutory 100-day deadline of April 9, 2025 to issue a final decision, and a unanimous vote of all three members is required to reverse Building Inspector John Field.
