Weston ZBA allows special permit applicant to withdraw, waives refiling fee

WESTON — September 24, 2024 — Weston's Zoning Board of Appeals voted 3-0 to let a special permit applicant withdraw his request without prejudice after he failed to appear at a continued hearing. Emery Patterson, seeking a special permit for an addition at 25 Conant Road on behalf of the Caravis et al. trustees, had already had his case continued once for an incomplete application; a September 17 email to staff read aloud at the meeting said he still needed architect revisions and health department and stormwater approvals that could take "another couple of weeks." Member Jane Fisher Carlson, presiding in place of Chair Stephen J. Larocque, moved to allow withdrawal and waive the refiling fee rather than set another date certain, calling a denial "draconian" but warning through staff that the board retains the power to deny when required documents are absent. Patterson must file a new, complete petition to return before the board.
