Weston ZBA Rejects Parking Compliance Finding for North Avenue 40B Project

WESTON — September 5, 2023 — Weston ZBA finds 269 North Avenue affordable housing parking plans non-compliant, continues case. The Zoning Board of Appeals voted 2-1 on September 5 to reject a motion that parking plans for a 16-unit Chapter 40B townhouse development comply with Section 8.8.2 of the Weston Zoning Bylaw, with Chair Jane Fisher Carlson in favor and members Stephen J. Larocque and Laura Mintz opposed. The dispute centers on whether outdoor tandem parking spaces measuring roughly 15 feet meet the bylaw's 350-square-foot maneuvering standard and whether they are "continuously available" as required. Attorney Brian Levy, representing developer 269 North Ave LLC, argued revised plans show 18-by-9-foot spaces with a 22-foot drive aisle yielding more than 350 square feet per space, while Planning Board member Leslie said 15-foot spaces "don't qualify" under her board's standards and called inadequate parking "a deal breaker." Town Counsel George Pucci of KP Law recommended the board require a formal notice of project change and waiver request by September 14, with the continued public hearing set for September 19 at 7 p.m.
