Weston ZBA finds 269 North Avenue project changes insubstantial in split vote
WESTON — November 27, 2023 — Weston ZBA splits 2-1 on 269 North Avenue 40B changes, then unanimously grants parking waiver. The board approved nine modifications to the 16-unit project — including widening one parking space by one foot, extending two end-space backups from 22 to 24 feet, replacing four snow-storage areas with permeable riprap, and installing heated pavement between buildings — as insubstantial under 760 CMR 56.05(11). Member Stephen J. Larocque, a licensed architect, voted no, joining abutters' attorney Dan Hill in arguing the changes were substantial "in the aggregate," including a roughly three-foot height increase on Building A. Acting Chair Jane Fisher Carlson and Associate Member Laura Mintz outvoted him. The board then unanimously waived Section 8A2's 350-square-foot and continually-available parking requirements, with Mintz saying she preferred a waiver because the plan "doesn't technically meet code." Applicant 269 North Ave LLC, represented by attorney Brian Levy of Beveridge & Diamond, withdrew its appeal of the building inspector's earlier determination.
