Weston ZBA Continues Oxbow Road Generator Hearing, Pushes Applicants to Special Permit

WESTON — June 2, 2022 — Weston ZBA steers Oxbow Road generator applicants away from variance toward special permit. The Zoning Board of Appeals voted 3-0 at its June 2 meeting to continue a variance hearing for Jeff and Erica Ziba of 41 Oxbow Road, with all three members — Chair Alan Rose, Steve Rock, and Natalie Sawyer — making clear the variance request likely lacks the votes to pass. Sawyer said she was troubled by the difficulty of reaching "that very high standard" when alternatives to the preferred location exist, even if only for aesthetic and practical reasons. Rose, the lone member who said the case "narrowly meets the variance statute," told the applicants their fastest path forward is to amend the application to a special permit and propose a front-corner location within the building envelope, which all three members indicated they could approve. The amended application and a revised plot sketch must be filed at least 48 hours before a continuation hearing set for June 9, 2022, at noon.
