Weston ZBA Continues Landscaping Business Permit, Approves Two Residential Special Permits

WESTON — August 9, 2022 — Weston ZBA continues contentious North Avenue landscaping permit, approves two residential special permits. The board, chaired by Alan Rose with members Natalie Sawyer and Steve LaRock, voted 3-0 to continue a commercial permit application and building inspector appeal by James Anza of 10 North Avenue until August 18 after his attorney failed to produce key dates and case law supporting a pre-existing nonconforming use claim and a state Chapter 40A, Section 7 limitations defense; Anza, who has operated a landscaping business on the residential-zoned property since 2001, also cited a comparable commercial permit previously granted to Michael Butera at 534 South Avenue as a model for conditions. In separate 3-0 votes, the board approved a special permit to convert a 1995 garage at 70 Black Oak Road into a caretaker's cottage for property owner Francis Palacurthy, conditioned on caretaker-only use and submission of a board of health approval document, and granted a special permit for a two-story addition at 68 Summer Street for owners Max and Paula Real, after architect Joseph Fournier reported the Weston Historical Commission unanimously approved revised plans and a Cambridge city representative found no objection to the project's proximity to a municipal reservoir.
