Weston ZBA Issues Storage Permit for Landscaper, Continues Appeal to October

WESTON — August 18, 2022 — Weston ZBA unanimously issues storage permit to 10 North Ave. landscaper, continues appeal to October 4. The Zoning Board of Appeals voted 3-0 at its August 18 meeting to grant a Section 5B5 storage permit to John Anza, whose landscaping and farming operation at 10 North Ave. has drawn a nine-point cease-and-desist order from the building department. Chair Alan Rose and members Natalie Sawyer and Steve LaRock determined they had authority only over storage — not business operations — citing the multi-decision "Butera" precedent. The permit covers a detailed inventory including up to four tractors, six dumpsters, four dump trucks, two bucket trucks, and materials ranging from firewood and nursery stock to brick and gravel. The board declined to rule on seven of the nine alleged violations, calling them operational matters outside ZBA jurisdiction, and continued the appeal with instructions for Anza to meet with the building department before October 4. Rose said he was "really bothered by the town coming in here and saying we never knew any of this stuff was going on," noting the activity has been open and documented for at least 20 years.
