Weston Planning Board advances Love Lane subdivision, seeks deed restriction on development
WESTON — November 7, 2018 — Weston Planning Board moves toward approval of flexible subdivision at 98 Love Lane, contingent on voluntary deed restrictions and conservation easement. Attorney Jonathan Witten, representing the property owners, proposed restricting each of two lots of slightly over 75,000 square feet to a single residence in perpetuity, an arrangement the board hopes will foreclose any future 40B filing. The board, noting the application is the first in roughly 20 years in which the density determination plan is itself a fully conforming subdivision, asked Town Counsel to confirm that a private deed restriction would be legally effective before signing off. The hearing was continued to December 5. Separately, the board put on hold a request to draw NWRA water for irrigation at 100 Ridgeway Road after a neighbor described driveway flooding caused by unfinished grading and an uninspected dry well, telling the applicant's representative, "The current owner and builder should be here tonight discussing this," and warning that no certificate of occupancy can issue until drainage conditions are satisfied.
